EQUIPMENT RENTAL AND TERMS OF RENTAL AGREEMENT:
The undersigned, as Lessee, hires Auxiliary Rental Services and Equipment Inc as Lessor, Bounce House rental equipment. Rental fee is due upon set-up at the location listed above.
DELIVERY: To the street address specified by Lessee. Lessee grants Lessor the right to enter the property at the above address for the delivery and subsequent pickup of the unit(s) at the specified time. If we are not granted access to property at pickup time you will be charged with an additional day rental.
LESSEE ACKNOWLEDGES THAT HE/SHE HAS BEEN INSTRUCTED ABOUT AND GIVEN A COPY OF AND FULLY UNDERSTANDS THE SAFE OPERATION OF THE UNIT THAT IS THE SUBJECT OF THIS RENTAL AGREEMENT. LESSEE AGREES TO OBSERVE ALL SAFETY PRECAUTIONS.
1.) GENERAL RULES TO FOLLOW DURING THE USE OF THE UNIT:
a) Only 5-6 persons of compatible age and size shall play in the unit at one time. (500 pounds total maximum weight for large units) Toddler units are strictly for toddlers. (150 pound maximum)
b) All riders MUST REMOVE SHOES, BELTS, AND JEWELRY before playing in the unit. CLOTHING WITH GROMETTS (e.g. jeans or jean shorts) are not allowed.
c) To avoid neck and back injuries, FLIPS OR SLIDING HEAD FIRST ARE NOT ALLOWED.
d) CHILDRENS SAFETY DEPENDS ON YOU. YOUR PERSONAL SUPERVISION IS ABSOLUTELY REQUIRED. As the lessee of the unit,
THE SAFETY OF ALL RIDERS AND PLAYERS IS LEESEE’s RESPONSIBILITY.
e) ABSOLUTELY NO STICKY SUBSTANCES ARE ALLOWED IN OR AROUND THE UNIT. This includes gum, candy, Silly String, water balloons, or any food or drink items. If, upon pick up, cleaning of above substances is required, a $50.00 minimum cleaning fee shall be automatically imposed.
f) All children unable to swim must wear proper floatation device on water units with a pool.
g) DO NOT MOVE THE UNIT from the place where it is installed. If the unit moves, pull the corner back to its original location of installation. CAUTION: Keep the unit away from swimming pools or any machinery that can generate heat. If you request a unit to be moved after set up there will be a fee based on drive time and availability of employees.
h.) SPECIAL INSTRUCTIONS and TROUBLE SHOOTING:
Should the unit begin to deflate:
1) The blower stopped. Check all connections from the outlet to the inflatable.
2) Reset GFIC circuit or try another outlet.
3) Check the vents on the side of the blower for blockage or debris.
4) Check that the sock/tube attached to the blower is not twisted or pinched off.

2.) SAFE OPERATION ACKNOWLEDGMENT: LESSEE ACKNOWLEDGES THAT HE/SHE HAS BEEN INSTRUCTED ABOUT AND FULLY UNDERSTANDS THE SAFE OPERATION OF THE UNIT THAT IS THE SUBJECT OF THIS RENTAL AGREEMENT. LESSEE AGREES TO OBSERVE ALL SAFETY PRECAUTIONS.
3.) Lessee represents and warrants safe return of the unit(s) and hereby agrees to pay Lessor up to$15,000 per unit if it is not returned or it is returned in unsalvageable condition as determined by the lessor. The Lessee also agrees to pay a minimum $100 repair fee for any repairs that require patching.
4.) ALTERATIONS AND ATTACHMENTS: No alterations in or attachments to the unit without prior written approval of the Lessor. This includes balloon strings, duct tape, and any other temporary decoration adhesives.
5.) TITLE TO THE UNIT: Lessee agrees to keep the unit in his/her custody and not to sublease, rent, sell, remove from the Delivery Address, or otherwise transfer such unit. The unit will remain the property of the Lessor and may be removed by the Lessor at any time after the termination of this Rental Agreement. Lessee grants to Lessor the right to come upon Lessee’s property at any reasonable time for the purpose of retaking possession of the unit(s).
6.) RELEASE OF LIABILITY:
A. Hold Harmless Provision: Lessee agrees to indemnify and hold lessor harmless from any and all claims, actions, suits, proceeding costs, expenses, damages and liabilities, including reasonable attorney’s fees arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of sited equipment including, but not limited to the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Lessee hereby releases and holds harmless Lessor from injuries or damages incurred as a result of the use of said equipment unless Lessor is operating the equipment and is deemed by a court of law to be negligent in its actions. Lessor cannot under any circumstances be held liable for injuries as a result of acts of God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless Lessor from any loss, damage, theft, or destruction of the equipment during term of this contact and any extension thereof.
B. Duty to Mitigate: In the event of injury, damage or loss due to Lessor’s negligence, Lessee agrees and assumes the duty to mitigate all costs resulting from said injury, damage or loss.
C. Merger Clause: This rental agreement constitutes the full agreement between Lessor and Lessee. No amendment, whether from previous or subsequent negotiations between the Lessee and the Lessor, shall be valid or enforceable unless in writing and signed by all parties to this contract. The invalidity or unenforceability of any particular provision of this Agreement shall not affect the other provisions hereof.
7.) WEATHER POLICY: Sever Weather will not be a valid reason for cancellation of a reservation or refund of any deposits or payments. In the event of a hurricane with a mandatory evacuation of the Event Address or rental warehouse, Lessor will offer a credit for a future booking of any available date. If severe weather conditions develop after drop off, Lessor shall be granted access to property at any time during the rental to pick unit up early. If conditions become severe enough during pickup time the pickup may be delayed up to 24 hours of original pickup time.
Units may be run in light rain. Units MUST be deflated during torrential rain, high winds 20 MPH or greater, lightning, hail, or any other hazardous condition. Unit may be inflated once weather has calmed.
8.) 811 POLICY: We cannot know where water, power, and cable lines are buried, if you believe there may be lines in the area where we are nailing in stakes, tell us immediately. Lessor is not responsible for damage to underground lines they have not been made aware of. Lessee is responsible for communicating any information to the delivery driver or marking any known lines with flags or marking paint if they cannot be onsite at the time of delivery and setup.
9.) Water Trampolines
Water Trampolines are for on the water use only, they cannot be used on land. Lessor will give lessee complete instructions on the use of these items and a demonstration, if necessary, at the time of pickup. Trampolines cannot be transported blown up. Any damage resulting from on land use, or transportation while inflated will incur charges for damages not less than $50.
10.) Public Parks and Community Centers
Any rental being delivered to a public park or community center must provide proof in writing that the venue allows the public to use water and power free of charge. If the customer does not provide this proof the necessary number of generators will be added to the rental at the current website price. It is not the policy of ARSE Rentals to abuse public resources, while we understand that some units are large and renters may not have the yard space, this is not a reason to let your local park foot the electrical and water costs of your party. We should all treat our public spaces with respect.
Please inform us at the time of booking if you are going to be at a public park. We need to check into gate access, opening and closing times, and any other rules and restrictions for that venue. We will do our best to accommodate all bookings, but if you do not contact the local park director and upon delivery we are told inflatables are not allowed at this park, there will be no refund. Please do your research before assuming all parks are the same.
11.) Facebook and Social Media
ARSE Rentals reserves the right and hereby notifies anyone posting to our social media profiles, we will copy and repost the best images and videos. In an effort to grow our business and advertise we will use any pictures and videos on our website, advertising in print or digital, and on new and emerging platforms. If you do not wish us to use your pictures and videos, please do not post them in a public forum. (We would much rather people see REAL people having fun with our products, not hired actors or models.)
That said we would also like to say thank you in advance to everyone who does like, share, subscribe, post and in any way spreads the word that we are here.
12.) Gelly Ball Disclaimer
Gelly Ball being similar to paint ball and other sports involving live fire is recognized by the lessee and their guests as inherently dangerous. Lessor will provide ample protective gear for the eyes and face to participants.
Lessor will provide an attendant for trouble shooting of equipment. Lessor’s representative, the attendant, will reserve the right to remove a player that is willfully or repeatedly endangering others i.e. shooting others at point blank range on purpose (under 6 feet); hitting, punching, kicking, or biting other players; older or larger players intentionally harming smaller or younger players; shooting other players not playing or waiting to re spawn; intentionally shooting at spectators or attendant; and any other unsafe or un sportsman like conduct.
Lessor’s representative, the attendant, will be more than happy to explain basic gun safety at the beginning of the game for any player who is unclear on this topic.
13.) Concession Rentals: All concessions must be property cleaned prior to pick up time. There will be a $35 cleaning fee applied if returned unclean.
14.) Damage Deposits
Lessee understands that:
· a one-hundred-dollar ($100) damage deposit will be added to total rental hire fee, it can be paid by cash, check, credit card, or digital payment in advance of the rental hire.
· it may be 3-5 business days before the inflatable that was returned can be reinflated, washed, and checked for damage. Lessee understand they will not receive a refund until this is done.
· If there is urine or feces of any kind anywhere on the inflatable; it is covered in mud or red clay; rigging ropes have been cut/burnt/removed; inflatable is ripped/cut/torn/burnt or otherwise damaged; any of the accessories are missing or damaged (blower, electrical cord, water hose, stakes, or tarps). Lessee forfeits the one-hundred-dollar ($100) damage deposit.
· they are liable for damage over one-hundred-dollars ($100) and not paying for major damages will bring legal action.
· urine or feces of any kind, human or animal; blood or other bodily fluids found on the inflatable will result in forfeiture of the damage deposit, permanent black listing from Lessor’s client list, and possible additional charges for cleaning.
15.) Damage Deposits restated in Common English
1.) I understand that:
· a one-hundred-dollar ($100) damage deposit has been added to total I have paid.
· each inflatable must be reinflated, washed, and checked for damage after pickup.
· It takes most of the week to clean everything from the last weekend.
· we need 3-5 days after the pickup date to check the inflatables and issue refunds.
2.) I am liable for damage over one-hundred-dollars ($100) and not paying for major damages will bring legal action.
3.) If the inflatable
· is covered in mud or red clay
· anything is ripped/cut/torn/burnt or otherwise damaged
· any of the accessories are missing or damaged (blower, ele cord, hose, stakes, or tarps)
· was part of a food fight, we will know, icing in stiches attracts ants even after cleaning.
I will forfeit the damage deposit and pay for the full cost of replacement, repairs, and cleaning.
4.) Urine or feces of any kind, human or animal; blood or other bodily fluids found on the inflatable will result in
· forfeiture of the damage deposit.
· permanent black listing of all the names, addresses, and phone numbers from that booking.
5.) Cleaning fee is $100/hr, repairs and replacements are calculated on a case-by-case basis.
